
Logic Minute 3-25-13
I’m Lynn Woolley with your Logic Minute.
True conservatives are conflicted on the issue of gay marriage now before the Supreme Court. The best course is to be logical and consistent. Therefore, even though we support DOMA (the Defense of Marriage Act), it is unconstitutional on the grounds that it is NOT among the enumerated powers of the federal government. Then again, neither are education, healthcare, or abortion. So if the high courts sends “marriage equality” – as liberals now call it – back to the states, it will be interesting to see if it does so on the grounds of Federalism.
If so, then here’s what might happen:
Bob and Steve get married in Boston but decide to move to Dallas. If Texas is, by law, a traditional marriage state, then Bob and Steve lose their marriage benefits with the move. We could soon have a two-tiered system for marriage, with gays being married in places like Massachusetts,Oregon and Illinois but NOT in Texas.
