A young boy was shot and killed by a child only two years older than himself.

According to a report from KFDA Channel 10, local authorities in Amarillo, Texas believe that a 9-year-old boy shot and killed a 7-year-old boy during an attempted burglary.

The Amarillo Homicide Unit has investigated the case and is unable to charge the 9-year-old with a crime since Texas law does not allow children under the age of 10 to be criminally responsible.

Amarillo police would be able to charge an adult if an adult had give the gun to the 9-year-old, but that is not the case in this matter. Police believe that the 9-year-old entered the home and found the gun on his own.

The child death investigation will be presented to the 47th district attorney's office for review.
